The foreclosure process in Florida typically takes between 8 and 14 months and can extend further.
The pre-foreclosure timeline usually lasts from 30 to 90 days, starting with the homeowner defaulting on the mortgage and the bank sending a letter to the homeowner. The homeowner then has 30 days to pay the mortgage before the bank files for foreclosure, which typically occurs 60 days after the letter’s 30-day deadline.
The Florida foreclosure process consists of several steps. First, the bank files a lawsuit and serves the homeowner, which may take around 15 days. If the homeowner cannot be served directly, the bank may use service by publication. The homeowner then has 20 days to respond, admitting or denying the allegations in the complaint and potentially filing Affirmative Defenses. In response, the bank will likely file a Motion to Strike.
The discovery phase follows and can last from 45 to 90 days. Both the bank and homeowner serve discovery on each other, with a 30-day deadline to respond. This phase includes Interrogatories, Requests for Production, and Requests for Admissions. The final hearing takes place 60 to 90 days later, during which the bank files a Motion for Summary Judgment, presents the Note and Mortgage, and refutes the homeowner’s defenses. If the bank is successful, the court sets a sale date, which occurs between 35 and 120 days after the judgment.

Mr. Charlip received his Juris Doctor degree from the University of Florida with Honors where he was the Executive Editor of the University of Florida Law Review.
